Although Abbott states that its policy applies globally to infant formulas, the policy omits many recommendations of The Code (as illustrated by an Initial Corporate Profile score in the Global Index 2018 of only 56%). Abbott's policy does align to The Code in relation to its commitments on product quality, which it states apply in every country. However, the policy states that to the extent that there is a difference between the standards set out in its policy and national law or regulation, it follows the national laws and regulations. In effect, this means that in any country where local regulations are weaker than its own policy, Abbott follows those regulations, or where there are no local regulations, it applies its own policy which, as outlined, does not align to the wording of The Code. Thus, in the United States, Abbott does not implement the majority of The Code’s BMS marketing recommendations.
